Welcome to Xenobuilds. These Terms of Service ("Terms") govern your access to and use of the Xenobuilds website, products, and services (collectively, the "Services"). By accessing, browsing, or purchasing from our Services, you agree to be legally bound by these Terms.
1. Use of the Services
You agree to use the Services only for lawful purposes and in compliance with all applicable local, state, federal, and international laws and regulations. 2. Products and Services
Xenobuilds offers physical and digital products, including but not limited to automotive designs, images, and related digital content. Product descriptions are provided as accurately as reasonably possible; however, we do not warrant that descriptions are error-free, complete, or current.
We reserve the right to modify, suspend, or discontinue any product or aspect of the Services at any time without notice.
3. Digital Products and License Grant
Unless expressly stated otherwise, all digital products are licensed, not sold. Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only.
You may not copy, reproduce, distribute, resell, sublicense, publicly display, or otherwise exploit any digital product without prior written consent from Xenobuilds.
4. Digital Delivery
All digital products are delivered electronically. Xenobuilds is not responsible for delivery failures caused by incorrect email addresses provided by you, spam/junk mail filters, internet service provider issues, or other technical issues beyond our reasonable control.
5. Compatibility
We do not guarantee that digital products will be compatible with all devices, operating systems, software, or platforms. You are solely responsible for ensuring compatibility prior to completing your purchase.
6. Payments and Refund Policy
All prices are listed in U.S. dollars unless otherwise stated. Payments are processed through third-party payment processors.
Due to the nature of digital products, all sales are final and non-refundable except where required by applicable law.
7. Intellectual Property Rights
All content made available through the Services, including designs, images, logos, text, and branding, is the exclusive property of Xenobuilds or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Unauthorized use of any content is strictly prohibited.
8. User Submissions
If you submit any content to Xenobuilds, including feedback, messages, or media, you grant Xenobuilds a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute such content for business and promotional purposes.
9. Disclaimer of Warranties
THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, XENOBUILDS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL XENOBUILDS, ITS OWNERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY, XENOBUILDS’ TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE LESSER OF:

The amount paid by you to Xenobuilds during the one (1) month period preceding the event giving rise to the claim, or

One hundred dollars ($100 USD).
Certain laws may not allow limitations of liability. In such cases, these limitations apply to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Xenobuilds from and against any claims, damages, losses, liabilities, and expenses arising from your violation of these Terms or misuse of the Services or products.
12. Term and Termination
These Terms remain in effect for as long as you access the Services or possess any licensed digital products. We may suspend or terminate your access to the Services at any time, without notice, for conduct that violates these Terms or applicable law.
All provisions which by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, and indemnification obligations.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Services. Your continued use of the Services constitutes acceptance of the revised Terms.
